These terms cover your use of ownersfit.com and the free Ownership Readiness Assessment (together, "OwnersFit"), run by OwnersFit ("we," "us"). By using OwnersFit, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the site.
1. Who can use OwnersFit
OwnersFit is intended for adults 18 and older. We don't knowingly collect information from anyone under 18. By using OwnersFit, you confirm that you are at least 18.
2. Educational information, not advice
OwnersFit is an educational tool. The assessment, your results, our guides, and any follow-up conversations, including with an advisor from our business-ownership advisory partner, are general information to help you think about owning a business. They are not financial, investment, legal, tax, or accounting advice. They don't create a professional or advisory relationship with us. Before you make a big decision, like buying or starting a business, borrowing money, or using retirement savings, talk with a qualified professional who knows your situation.
3. No guarantee of outcomes
Owning a business is risky. You could lose the money you put in. A strong result doesn't mean you will succeed, and a weak result doesn't mean you can't. We don't promise any particular result, income, or outcome.
4. How the assessment works and its limits
Your results are based only on the answers you give and on a scoring method we designed (see our methodology page). That means:
- Your results are only as accurate as your answers.
- The assessment can't account for everything about you, your finances, your market, or any specific business.
- We may change the questions or scoring at any time, so your results could be different later.
5. Your information and follow-up
When you take the assessment, we ask for your first name, email, and phone number. Your email and phone number are required to see your results. Please use only your own contact information, and make sure it's accurate.
By submitting the assessment, you agree that OwnersFit may email you about your results and may share your name, contact info, and results with a business-ownership advisory partner. You also agree that the partner's advisor may call, text, or email you about your results and business-ownership options at the contact info you provided, including by automated technology, as described in our Privacy Policy. OwnersFit itself contacts you only by email. Consent isn't a condition of any purchase. Message and data rates may apply. Message frequency varies.
You can opt out at any time by replying STOP to a text, telling the caller, using the unsubscribe link in any email, or emailing hello@ownersfit.com, and we'll pass your request along to our advisory partner. Opting out doesn't affect results we've already given you.
6. Acceptable use
Please use OwnersFit only for lawful, personal purposes. Don't:
- Enter someone else's contact information without their permission.
- Submit false, spam, or automated entries.
- Try to hack, overload, scrape, or interfere with the site.
- Copy, resell, or republish our assessment, scoring, or content.
- Use the site in a way that breaks any law or harms others.
We may block or remove access for anyone who misuses the site.
7. Our content and intellectual property
The OwnersFit name, logo, assessment questions, scoring method, guides, and design belong to OwnersFit or are used with permission. They are protected by copyright, trademark, and other laws. You may view our pages, share links to them, and save your own results for personal use. You may not copy, change, or use our content commercially without our written permission.
8. Third-party links and services
OwnersFit may link to other websites or use third-party services. We don't control them and aren't responsible for their content, policies, or practices. Our business-ownership advisory partner is a separate business. It is responsible for its own advice, services, conduct, and privacy practices. It may be compensated by businesses it introduces you to if you choose to work with one.
9. No warranties
OwnersFit is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties of any kind, express or implied. This includes warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We don't promise the site will always be available, error-free, or secure.
10. Limitation of liability
To the fullest extent permitted by law, OwnersFit and the people who run it are not liable for any indirect, incidental, special, consequential, punitive, or similar damages. This includes lost profits, lost savings, and lost data. It applies to claims arising from your use of OwnersFit, your inability to use it, or decisions you make based on it. Beyond that, our liability is limited to the fullest extent permitted by law. Some places don't allow these limits, so some of them may not apply to you.
11. Indemnity
If you misuse OwnersFit or break these terms, and that leads to a claim against us, you agree to cover the reasonable costs caused by your misuse, including reasonable legal fees.
12. Governing law and resolving problems
Email us first. If you have a problem with OwnersFit, please email hello@ownersfit.com before taking any formal action. Tell us what happened, and we'll try in good faith to sort it out informally.
These terms are governed by California law, without regard to its conflict-of-law rules. If a dispute can't be resolved informally, it will be handled in the state or federal courts located in California, and you and we agree to their jurisdiction.
13. Changes to these terms
We may update these terms from time to time. When we do, we'll post the new version on this page and change the "Last updated" date above. If you keep using OwnersFit after a change, you accept the updated terms.
14. General
If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce part of these terms right away, we can still enforce it later. These terms and our Privacy Policy are the entire agreement between you and us about using OwnersFit.
